STATEMENT OF SUPPORT OF HB537 AND SB520 – PERTAINING TO SUPPLEMENTAL BIRTH CERTIFICATES
Log Cabin Republicans of Texas has decided to voice their support of HB 537, authored by Reps. Rafael Anchia, Celia Israel, Garnet Coleman, Elliott Naishtat, and Mary Gonzalez, and SB250, authored by Sens. Sylvia Garcia and Jose Rodriguez. Both bills pertain to Supplemental Birth Certificates.
The State of Texas currently allows for only one person of each gender to be listed on a supplemental adoption birth certificate. This impedes single parents from adding another family member of the same sex (i.e. aunt, uncle, or grandparent of the child) to the birth certificate by way of adoption to protect the interests and chain of custody of their child(ren) should something occur to the single parent and they are no longer able to care for their child(ren).
HB 537 and SB250 would reword supplemental adoption birth certificates to be gender neutral, which would allow any two guardians, care providers, or parents to be listed on the document.
STATEMENT OF SUPPORT OF HB71 AND SB492 – PERTAINING TO THE ROMEO AND JULIET LAW
Log Cabin Republicans of Texas has decided to voice their support of HB 71, authored by Rep. Mary Gonzalez, and SB492, authored by Sen. John Whitmire. Both bills pertain to the Romeo and Juliet Law.
The State of Texas passed a Romeo and Juliet law to protect minors who engage in consensual sexual activity from criminal prosecution. To this effect, any minor engaged in said activity from the ages of 14-17 will be shielded from criminal prosecution. This prevents children from being labeled as sex offenders and ensures that parents, not the government, are the ones most equipped to set moral standards for their children.
The Log Cabin Republicans supports eliminating a loophole in the law which treats minors differently based on the gender and sexual orientation of the minors involved. We believe the State of Texas should protect all our children from undue and unnecessary criminal prosecution.
In the regular 2013 session this bill was HB 2403 authored by Rep. Gonzalez and Rep. Moody. And SB 1316 authored by Sen. Whitmire. The legislation was endorsed by both the House Criminal Jurisprudence Committee and the Senate Criminal Justice Committee.
STATEMENT OF OPPOSITION TO HB1745, HB4105, AND SB673 – PERTAINING TO THE ISSUANCE OF SAME-SEX MARRIAGE LICENSES
Log Cabin Republicans of Texas has decided to voice their opposition to HB1745 and HB4105, both authored by Rep. Cecil Bell and SB673 authored by Sen. Charles Perry.
HB1745, HB4105 and SB673 would prohibit the use of state funds to issue marriage licenses to same-sex couples. For the past decade, Texas has had a Constitutional Amendment banning same-sex marriage in the state, therefore already barring the issuance of marriage licenses to same-sex couples. Thus, the bills authored by Bell and Perry exist in an alternate reality and would effectively do nothing under today’s laws. For our State Legislators to even discuss bills that base their enforcement on hypotheticals, suppositions, what ifs, and maybes is a waste of our Legislator’s time and a waste of taxpayer money.
If Rep. Bell and Sen. Perry stand behind their bills and wish to make them effective immediately, then Log Cabin Republicans of Texas advises them to push for a Constitutional Amendment to strike down the same-sex marriage ban. Otherwise, we ask Rep. Bell and Sen. Perry to withdraw their bills and cease this waste of time and money.
